Is Marihuana Legal In Malta?

Legality - Malta Marihuana

Malta has recently made significant strides in the legalization of cannabis. On 18 February 2021, Prime Minister Robert Abela announced plans to introduce a law that would legalize the possession of a small amount of cannabis and plants for personal use. Fast forward to 14 December 2021, the cultivation and use of recreational cannabis was officially legalized for individuals aged 18 and above in Malta.

Personal Possession and Cultivation Limits

Under Malta’s new law, individuals can carry up to 7 grams of cannabis, while households are allowed to cultivate up to 4 plants and store up to 50 grams of dried cannabis. Cannabis Social Clubs facilitate member cultivation with limits of 7 grams per day and 50 grams per month. Non-profit organizations can also grow cannabis for sale to a maximum of 500 members, albeit with restrictions. Smoking cannabis in public remains prohibited, and possession of up to 28 grams may result in fines ranging from €50 to €100 without a criminal record.

The Authority on the Responsible Use of Cannabis

As of 18 December 2021, the law came into effect with the official signature of President George Vella. The Authority on the Responsible Use of Cannabis was established as a new public body in Malta to manage the implementation and regulation of the new cannabis law. This development marks a significant advancement in the decriminalization and regulation of cannabis in Malta, providing more freedom for individual use while maintaining appropriate public safety measures.

Malta’s Responsible Use of Cannabis Act establishes new regulations for cannabis, allowing adults over 18 to possess, buy, or cultivate within set limits. Individuals can possess up to seven grams or store up to 50 grams at home, and previous possession convictions can be expunged.

Associations like cannabis clubs can grow and distribute cannabis among members, but fines up to €100 apply for possession of 7-28 grams, and smoking in public incurs fines up to €235, rising to €500 if a child is present. Minors caught with cannabis are referred to a justice commission for a care plan rather than facing arrest.
