Terms Of The Legislation Of Cannabis in Switzerland

signing agreements - Legalization Of Cannabis Switzerland

Switzerland has taken some progressive steps towards cannabis legalization. First off, it decriminalized the possession of small amounts of marijuana in 2012. So, if you were caught with 10 grams or less, the cops would just take it away with no fine or citation. If you were busted for puffing on the herb, though, you’d have to fork over a 100 CHF (102 EUR) fine and probably end up on some kind of list for cannabis users.

Switzerland ran a pilot program where 2,100 residents in Zurich legally purchased cannabis from pharmacies and clubs. This research aimed to understand cannabis use patterns, health effects, and societal impacts before potentially legalizing it nationwide.

The Move Towards Legalization Of Recreational Cannabis

Move towards legalization - Legalization Of Cannabis Switzerland

In Switzerland, the move towards legalizing recreational cannabis has been a long and winding road. Over the years, various attempts have been made to adopt a less restrictive cannabis policy, with some proposals failing to gain traction. In recent years, the country has taken a more systematic approach to cannabis reform.

Evidence-Based Approach

Rather than haphazardly relaxing cannabis policies, Switzerland prefers to establish a robust legal framework for changes based on scientific evidence. In this vein, several pilot projects were developed to provide marijuana and hash to adult volunteers for recreational purposes. The goal of these programs was to study the effects of cannabis use on participants and society.

Basel: First Legal Dispensary Opens for Pilot Project

One of the successful pilot projects was initiated in the city of Basel, where the first legal marijuana dispensary opened its doors in December 2023. The city of Lausanne approved the Cann-L project in 2021 to experiment with marijuana sales, aiming to monitor black market dynamics and consumer behavior. The first legal dispensary in Lausanne opened in December 2023, selling marijuana exclusively to program participants for between 9 and 12 Swiss francs per gram.

Lausanne and Grashaus Projects: Monitoring Market Dynamics and Product Variety

The Grashaus Project also received approval from the FOPH and opened its first cannabis store dedicated to selling various products, including flowers, hashish, extracts, vape liquids, and edibles. This establishment in the northwestern Swiss canton of Basel-Landschaft marked the opening of the first legal cannabis specialist shop in Europe, providing a range of cannabis products to registered pilot program participants.

Medical Cannabis Laws In Switzerland

Medical cannabis - Legalization Of Cannabis Switzerland

Medical cannabis is legal in Switzerland. Switzerland first legalized medical cannabis in 2008, but the law took effect in 2011. Previously, medical cannabis patients needed a special permit from the Federal Office of Public Health to be able to access cannabis. In March 2021, the Federal Council amended the Swiss Narcotics Act to lift the ban on medical cannabis

Streamlined Patient Access and Commercial Opportunity

With this amendment, patients will be able to bypass the federal office and access cannabis directly from pharmacies. In addition, Swiss companies will now be able to export medical cannabis commercially as long as they have the requisite authorization from Swiss Medic, the Swiss surveillance authority for medicines and medical devices.

Treatment for Childhood Epilepsy

Epidiolex was approved by the European Medicines Agency in September 2019. This is a cannabis-based drug that is used to treat rare forms of severe childhood epilepsy.

Is It Legal To Grow Cannabis In Switzerland?

Cannabis Cultivation

In 2012, an attempt was made to legalize the personal cultivation of up to 4 plants of the non-intoxicating variety (containing less than 1% THC). For a while, it was legal in several cantons, such as Geneva and  Freiburg, but later the same year, the federal court ruled it was against the existing drug laws.

Cannabis Seeds in Switzerland

Like almost anywhere else in the world, it’s not difficult for residents of Switzerland to obtain cannabis seeds online. There are enough international marketplaces that will ship your order to the country. As for brick-and-mortar shops, you’re unlikely to find one selling seeds that produce high-THC plants. Even those shops that have rows upon rows of buds on display and look just like a US dispensary only trade in CBD and CBG seeds.

The FOPH can grant exceptional authorizations for the cultivation of cannabis with a THC content of more than 1%. Such authorizations are only issued for purposes related to a limited medical application, scientific research, or the development of medicines. The rules for medical cannabis products are not the same, as they are dictated by SwissMedic directly. Only this organization can validate a medical cannabis product.

Authorization to cultivate cannabis for pilot tests

A request for authorization to cultivate recreational cannabis (THC > 1%) for pilot tests must be submitted to the FOPH. Once the application has been studied, the Federal Office of Public Health will decide if the project is feasible.

To become a producer of recreational cannabis within the framework of the pilot tests, it is necessary :

  • The production of hemp must be entirely made in Switzerland
  • Follow the regulations on organic farming
  • Respect the rules of good agricultural practices for the cultivation of medicinal plants.
  • The cannabis mustn’t exceed 20% THC, as well as respect a certain number of quality criteria (art. 9 OEPStup).

It is necessary to produce indoors in order to homogenize the quality of the plants and their THC concentration. Outside, many external elements can influence the parameters of the plants.

CBD Flower Production is Legal in Switzerland

While cannabis production is still undergoing its pilot program, CBD flower production has been legal in Switzerland since 2017. Cultivators and producers are allowed to grow flowers and CBD products that contain less than 1 percent THC. These products don’t fall under the Narcotics Act.

This does not mean that CBD products are unregulated. They must still comply with the law and adhere to respective regulations. For example, if a producer sells CBD oil, it may be classified as a ‘foodstuff’ and must comply with respective federal law safety guidelines.

The Swiss CBD Market is Growing Quickly

The Swiss are using the CBD loophole to get ‘similar’ products to cannabis without having to go through pilot programs. In fact, the Swiss CBD market is expected to grow 39% per year, with some experts predicting that the CBD industry in Switzerland will reach CHF 320 million ($318 million) by 2027. Some of the largest ‘cannabis’ producers in Switzerland are producing CBD products while the government rolls out and refines their cannabis licensing process.

Is CBD Legal?

Is CBD legal - Legalization Of Cannabis Switzerland

Switzerland is known for its stunning landscapes, world-class chocolate, and iconic watches. But did you know that this alpine wonderland also has some of the most progressive cannabis laws in Europe? That’s right – Switzerland’s stance on cannabis is a testament to its forward-thinking policies and a beacon of hope for the hemp industry.

CBD and THC: The Dynamic Duo

In Switzerland, the limit for THC in finished cannabis products is 1%. This represents a stark difference from other European countries, where the limit is much lower (0.2% to 0.3%). This lenient threshold means that Swiss farmers and entrepreneurs are less likely to exceed the THC content of their products, avoiding legal entanglements.

The Green Rush: Cultivating Industrial Hemp

Industrial hemp is legal in Switzerland as long as it contains less than 1% THC, irrespective of CBD content. This green light comes with a few caveats, though. Cultivating hemp seed requires a special permit, and the THC content must comply with the law. Following federal regulations, hemp can be transformed into various products, such as food, cosmetics, and medical extracts.

CBD Under the Microscope

In Switzerland, CBD medicinal products are subject to the stringent regulations that apply to medical goods. Foods from non-CBD hemp sources (such as oil, flour, and seeds) can be marketed without prior authorization. Cosmetics with natural CBD derived from hemp seeds or leaves are also legal, while synthetic CBD is unregulated.

Are you ready to harness the potential of the Swiss hemp industry? The country’s progressive CBD laws open many possibilities for entrepreneurs and consumers alike. So, grab your seeds, roll up your sleeves, and get ready to cultivate the future of industrial hemp in the heart of Europe!
