Medical cannabis is legal in Switzerland. Switzerland first legalized medical cannabis in 2008, but the law took effect in 2011. There are enough international marketplaces that will ship your order to the country. As for brick-and-mortar shops, you’re unlikely to find one selling seeds that produce high-THC plants. Even those shops that have rows upon rows of buds on display and look just like a US dispensary only trade in CBD and CBG seeds.
The FOPH can grant exceptional authorizations for the cultivation of cannabis with a THC content of more than 1%. Such authorizations are only issued for purposes related to a limited medical application, scientific research, or the development of medicines. The rules for medical cannabis products are not the same, as they are dictated by SwissMedic directly. Only this organization can validate a medical cannabis product.
Authorization to cultivate cannabis for pilot tests
A request for authorization to cultivate recreational cannabis (THC > 1%) for pilot tests must be submitted to the FOPH. Once the application has been studied, the Federal Office of Public Health will decide if the project is feasible.
To become a producer of recreational cannabis within the framework of the pilot tests, it is necessary :
- The production of hemp must be entirely made in Switzerland
- Follow the regulations on organic farming
- Respect the rules of good agricultural practices for the cultivation of medicinal plants.
- The cannabis mustn’t exceed 20% THC, as well as respect a certain number of quality criteria (art. 9 OEPStup).
It is necessary to produce indoors in order to homogenize the quality of the plants and their THC concentration. Outside, many external elements can influence the parameters of the plants.
CBD Flower Production is Legal in Switzerland
While cannabis production is still undergoing its pilot program, CBD flower production has been legal in Switzerland since 2017. Cultivators and producers are allowed to grow flowers and CBD products that contain less than 1 percent THC. These products don’t fall under the Narcotics Act.
