Then keep reading to discover the ins and outs of the Act Cannabis Law and how it applies to the field of cannabis.
Understanding The ACT Cannabis Law
The ACT has removed penalties for adults over 18 who possess or use small amounts of cannabis so they can get support without fear of being put through the justice system. New rules around personal use of cannabis came into effect on the 31st of January 2020. The Drugs of Dependence (Personal Cannabis Use) Amendment Act 2019 (ACT) amended the Drugs of Dependence Act 1989 (ACT) to remove penalties for persons over the age of 18 years for the possession of up to 50 grams of dry cannabis or 150 grams of “fresh cannabis,” or for growing up to two cannabis plants per person, with a maximum of four plants per household.
Legalization of Possession, Cultivation, and Use
On January 31, 2020, Australian Capital Territory (ACT) legislation allowing the possession and cultivation of cannabis for personal use came into effect. This legislation, which was passed by the ACT Parliament in September 2019, allows individuals over the age of 18 years to possess up to 50 grams of dry cannabis or 150 grams of “fresh cannabis” and grow up to two cannabis plants per person, with a maximum of four plants per household. This move by the ACT has laid the foundation for a more open and accepting approach towards cannabis use and cultivation, providing adults with the freedom to make personal choices without the fear of legal repercussions.
Changes In The ACT Cannabis Law
The new changes to the ACT cannabis law have made a significant impact on the residents of the city. In the field, I can tell you some crucial information about these changes and what they mean for those who reside in the area. Now, if you are aged 18 or older in the ACT, you can possess up to 50 grams of dried cannabis or up to 150 grams of fresh cannabis. You can grow up to two cannabis plants per person, with a maximum of four plants per household, and also use cannabis in your home for personal use.
Key Prohibitions Under the New Cannabis Law
The new law is very clear on what is considered illegal, so it is essential to follow these rules. It is illegal to smoke or use cannabis in a public place, expose a child or young person to cannabis smoke, store cannabis where children can reach it, grow cannabis using hydroponics or artificial cultivation, and grow cannabis plants where they can be accessed by the public.
Unchanged Regulations Despite Cannabis Legalization
Some rules have remained the same despite the legalization of cannabis. It is still illegal to sell, share, or give cannabis as a gift to another person, for people under the age of 18 to grow, have, or use cannabis, and to drive with any amount of cannabis in your system. Understanding these rules is crucial to ensure you are compliant with the law and avoid any legal issues.

What Happens When Someone Is Found With A Small Amount Of Cannabis?
Possession of small amounts of cannabis and one or two plants remains an offense under the amended Drugs of Dependence Act. However, the Act creates exceptions for certain groups of people. These offenses remain simple cannabis offenses under the Act. If a police officer reasonably believes that an individual has committed a simple cannabis offense, and is not an exempt person, they may issue a Simple Cannabis Offence Notice (SCON). Those under the age of 18 are not exempt people under the Act and may be issued an SCON.
To satisfy the Simple Drug Offence Notice, the following must be completed within 60 days
- The person can then pay the fine via the Access Canberra website, over the phone or in person; or
- If the person decides they don’t want to pay the SDON, they can contact Canberra Health Services to complete a health session. Once the person has attended the session there will then be no further action.

What Happens When Someone Is Found With A Larger Amount Of Cannabis?
In the ACT, a strong stance is taken against drug trafficking and drug dealers. If individuals are found in possession of larger amounts of cannabis, above the new ‘small quantity’ thresholds but below drug trafficking limits, they may face higher fines of up to $8,000 and potential prison sentences of up to 6 months. This is a significant reduction from the previous potential prison sentence of 2 years for possession of larger amounts of cannabis.

How Does The ACT Cannabis Law Affect Licensed Manufacturers And Producers?
The ACT cannabis law legalizes cannabis for personal use but keeps cannabis selling and supply illegal. As a result, licensed manufacturers may not see a significant boost in business. The focus should remain on medical cannabis and the potential for export. Cannabis seeds are still illegal, and there’s no allowance for large-scale commercial cultivation.
