The landmark legislation allows for adult possession of up to 25 grams of cannabis for personal use in public. Three live cannabis plants will be legal in one’s own home and up to 50 grams of cannabis for personal use there. Smoking weed in public spaces is allowed, except near schools and sports facilities. The new law makes Germany the third European Union country to legalize cannabis for personal use, alongside Malta and Luxembourg.

But unlike in the neighboring Netherlands or Canada, for example, the new law does not foresee weed to be legally sold at commercial cannabis shops – instead, people can join so-called non-profit cannabis social clubs where plants are grown collectively. From July 1, these clubs are allowed to apply for a licence to grow weed, three months after the legislation came into force.

What constitutes a “small amount” was a grey area for a while. Each state was left to decide this for itself. But recent developments are aiming to set clear, nationwide limits on this. In addition to decriminalization, the German government also wants to ensure that cannabis products come from officially approved sources. Hence, cannabis clubs serve as a middle ground. What Are The Rules And Prohibitions Of German Cannabis Clubs?

According to the plans now presented, these clubs are to be organized in exactly the same way as other registered associations in Germany. 

• They cannot have more than 500 members. 
• They are allowed to “cultivate cannabis for recreational purposes and distribute it to members for personal consumption, as well as seeds and cuttings for personal cultivation.” This is how the Federal Minister of Health, Prof. Karl Lauterbach, and the Federal Minister of Agriculture, Cem Özdemir, put it at the beginning of April. 
• Only the members of the club are allowed to participate in the cultivation, no outsiders.
• These clubs are allowed to hand out a maximum of 25 grams of cannabis per day to a member, and no more than 50 grams per month. 
• A maximum of 7 seeds or 5 cuttings per month. 
• For people under 21, the maximum is 30 grams per month. 
• The THC content in this case should be limited. THC (tetrahydrocannabinol) is responsible for the cannabis high.

Quality specifications for cultivation include no additives, no synthetic cannabinoids, and the limited use of plant protection products.

Import and Export Restrictions

Pleasure cannabis clubs are not allowed to import or export products. The focus is on restricting marijuana products to the club, with members obtaining seeds for cultivation through the club in a manner that is still being determined. The club may not allow marijuana consumption on its premises, and alcohol, tobacco, or other stimulants and intoxicants may not be available.

Future Possibilities

In the future, cannabis clubs in Germany may be able to sell seeds or cuttings for private cultivation to individuals without club membership, pending final approval. How Can You Start A Club In Germany?

• The number of associations permitted may be limited based on population density, and individuals must be checked for reliability. 
• The management of the club must consist of natural persons, and youth protection, addiction, and prevention officers with proven expertise are required. 
• Clubs must cooperate with local addiction prevention and counseling centers and maintain a minimum distance from schools and similar institutions. 
• Advertising is generally banned, except for factual information, and clubs must adhere to minimum protection measures for their premises and annex. 
• The association must also be governed in accordance with the principles of the law of associations.

How Can I Become A Member?

An important basic condition for membership: 

• The minimum age is 18. A strict age check is mandatory. 
• Members must have their “domicile or habitual residence” in Germany. 
• A person can be a member of only one such club.

Cannabis clubs could, of course, set their own rules and conditions. At the same time, members are subject to all rights and obligations that belong to an association membership.

For example, members have the right to attend club events, request (or even force) a general meeting, and stand for election to a position within the club. Their duties, in turn, include paying their dues and “promoting the interests of the association and refraining from conduct detrimental to the association,” according to the Federal Ministry of Justice.
