The Legal Framework Of Cannabis Clubs In Germany

  • Adults are allowed to privately grow up to three cannabis plants for their own consumption as well as communal, non-commercial self-cultivation for their own consumption in cultivation associations or Cooperatives allowed.
  • Possession of up to 25 grams of cannabis will in future be exempt from punishment.
  • There is a general ban on advertising and sponsorship for consumer cannabis and cultivation associations.
  • Ban on consumption of cannabis in a protection zone of 200 meters from the entrance area of cultivation associations, schools, children’s and youth facilities, children’s playgrounds and in publicly accessible sports facilities.
  • Non-commercial cultivation associations may only cultivate consumer cannabis jointly with the active participation of members and pass it on to members for their own consumption with official permission. Strict legal framework conditions must be adhered to.
  • Growing associations may have a maximum of 500 members; Members must be adults and have their place of residence or habitual abode in Germany.
  • Compliance with strict quantity, quality and child and youth protection requirements is required, secured by official controls.
  • Limitation of the distribution of consumer cannabis in cultivation associations: distribution only to members, combined with a strict obligation to verify membership and age – max. 25 grams per day / 50 grams per month.
  • Limiting distribution to adolescents between 18 and 21 years of age to 30 grams per month with a limit on the permissible THC content to 10 percent.
  • Distribution of consumer cannabis in controlled quality and only in its pure form, i.e., marijuana or hashish.
  • Private home cultivation permitted to a limited extent with an obligation to protect privately grown consumer cannabis from access by children and young people as well as third parties.

When founding a Cannabis Social Club (CSC) in Germany, there are specific requirements that must be met according to Section 10 of the Cannabis Act (CanG). The CSC must be founded as a registered association and abide by certain regulations.

After creating the Cannabis Social Club, it needs to be entered into the register of associations to acquire legal capacity. Certain requirements must be met for registration, such as specific provisions in the articles of association, a minimum number of members, and a maximum number of members. An individual can only be a member of one growers’ association.

Application for Authorization of the Cannabis Club

Once the CSC is prepared for registration, the application for entry in the register of associations is submitted to the competent court through a notary. It is essential that the articles of association, especially the purpose of the association, are meticulously drafted. Further provisions are required to obtain authorization, such as measures for the protection of minors, addiction awareness, and prevention counseling, among others. When all legal requirements are met, the club can proceed with applying for authorization.

How Is Germany’s Cannabis Club Different From “Cannabis Social Clubs” In Other Countries?

Similar models to the one now planned in Germany have long been known to insiders from other places. Such facilities were already popular in the 1920s, for example, in the USA, when alcohol was banned in the wake of Prohibition. The European Coalition for Just and Effective Drug Policies (ENCOD) brought up the term “cannabis social club” in 2005 to revive the idea.

Cannabis clubs have varying legal statuses across different countries. In Malta, they became legal in December 2021, while Switzerland is experimenting with pilot projects. Spain operates in a legal gray area with over 200 clubs in Barcelona alone, lacking formal regulation. In Germany, clubs have operated independently in the past, but unlike elsewhere, the current plan does not permit on-site consumption, focusing solely on distribution.
